1 Petitioner having given an undertaking cannot seek for the post of Junior Assistant as soon as the vacancy arises only on the ground that he was appointed for a subordinate post as there was no vacancy for the post of Junior Assistant at the relevant time. The petitioner will get his chances of promotion only as per the order of his seniority in the lower post.
2 The prior entrants cannot be deprived of promotion, so that the later entrants could have a march over them, which course would only work against the settled principles of law.
3 The petitioner a Post Graduate - working as sweeper at Town Panchayat - petitioner's father died in harness while in service - at the time of appointment, he is a Degree holder - Government is directed to issue suitable orders to appoint the petitioner in the post of Junior Assistant - petition allowed.
4 Seniority to be determined in relation to the directly recruited officers after reckoning the date on which their services were regularised - The appellant has retired from service as also the other candidates - selection of Principal involves merit and ability, apart from seniority, claim of the appellant to promote him as Principal cannot be acceded to at this point of time.
